These Terms and Conditions ("Terms") constitute a legally binding agreement between you (whether individually as a student, parent, guardian, or educator, referred to as "User" or "you") and MargDarshak ("we", "us", or "our") concerning your access to and use of the website https://margdarshak.in and related predictive tools, databases, and services.
By visiting, browsing, or utilizing any feature of MargDarshak, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you are prohibited from using the platform.
Nature of Prediction Service & Algorithms
MargDarshak provides algorithmic cutoff estimation tools, seat matrix lookups, college comparisons, and choice preference list builders for competitive entrance examinations in India, including:
- NEET UG (National Eligibility cum Entrance Test for Undergraduate Medical / MBBS / BDS / BAMS)
- JEE Main (Joint Entrance Examination Main for NITs, IIITs, GFTIs)
- JEE Advanced (Joint Entrance Examination Advanced for all 23 IITs)
- NEET PG (National Eligibility cum Entrance Test for Postgraduate Medical Specialties / MD / MS / DNB)
Crucial Counseling Disclaimer
All admission chances labeled as "Safe (>85% Chance)", "Target (50-85% Chance)", or "Ambitious (<50% Chance)" are statistical estimates derived from historical opening and closing ranks. Cutoffs fluctuate annually based on candidate volume, exam difficulty, seat additions, and student preferences. MargDarshak does NOT guarantee seat allotment in any institution.
Official Counseling Body Non-Affiliation
MargDarshak is an independent educational technology and data explorer initiative. We are strictly not affiliated with, authorized by, sponsored by, or in any way officially connected with:
Central Authorities
National Testing Agency (NTA), Directorate General of Health Services (DGHS), Medical Counselling Committee (MCC), National Medical Commission (NMC).
Engineering Allocation
Joint Seat Allocation Authority (JoSAA), Central Seat Allocation Board (CSAB), IIT Organizing Committees, or National Institutes of Technology Councils.
All registered trademarks, acronyms, and institutional names (such as IIT, NIT, AIIMS, JoSAA, MCC) are the property of their respective statutory bodies. Their mention on MargDarshak is strictly for nominative, educational, and identification purposes under Indian fair use doctrine.
Data Sources, Fee Disclosures & Accuracy
We source our datasets from publicly released official counseling archives, information bulletins, and institutional disclosures:
- Cutoff Ranks: Extracted directly from JoSAA Rounds 1–6 and MCC Rounds 1, 2, 3 (Mop-Up), and Stray Vacancy archival records.
- Annual Tuition Fees: Based on official institute brochures and State Fee Regulatory Committees. Fees are subject to revision by respective institutes without prior notice.
- Service Bonds & Penalties: Compiled from state government medical education department notifications. Students must verify specific service bond liabilities with the college nodal officer during physical reporting.
Acceptable User Conduct & Anti-Scraping
You agree to use MargDarshak solely for lawful personal educational guidance. You expressly agree that you will not:
- Deploy automated crawlers, scrapers, bots, or extraction scripts to harvest proprietary datasets, logos, or algorithms.
- Attempt to reverse-engineer, decompile, or modify the algorithmic code or calculation models.
- Impose an unreasonable or disproportionately heavy load on our infrastructure or attempt Denial of Service (DoS) attacks.
- Repackage, white-label, or commercially resell MargDarshak college directory data without written authorization.
Intellectual Property Rights
The MargDarshak platform, including its software architecture, user interface designs, custom CSS styling, ranking algorithms, logos, choice preference sorting scripts, and textual compilations, are the intellectual property of MargDarshak Education and are protected under Indian Copyright and Trademark laws.
Individual students are granted a non-exclusive, revocable, non-transferable license to generate and download their personal choice lists for personal counseling strategy.
External Links & Third-Party Portals
MargDarshak provides external hyperlinks to official college portals, state DME sites, and official counseling portals (such as mcc.nic.in and josaa.nic.in). We have no control over the content, security, availability, or policies of third-party domains and accept no responsibility for any loss or dispute arising from your access to them.
Disclaimer of Warranties ('As-Is')
The services, tools, rank calculations, and college directory are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
No Professional Counseling Guarantee
MargDarshak does not warrant that the predictions will be error-free, uninterrupted, or that every institutional seat matrix change made mid-counseling by state authorities will be reflected instantaneously.
Limitation of Liability
To the fullest extent permitted by applicable Indian law, MargDarshak and its operators, developers, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:
- Any decision made or action taken by you or any third party in reliance on predictions generated on this site.
- Failure to secure admission, non-allotment of preferred seats, or cancellation of candidature in any counseling process.
- Discrepancies between historical cutoffs and current year closing ranks caused by shifts in candidate rank distributions.
Indemnification
You agree to defend, indemnify, and hold harmless MargDarshak, its creators, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your breach of these Terms or misuse of the platform.
Governing Law & Dispute Resolution
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any legal dispute or claim arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
Modifications to Terms & Inquiries
We reserve the right to revise or update these Terms at any time without prior individual notice. Any modifications become effective immediately upon posting to this URL. Continued use of MargDarshak following any update constitutes acceptance of the amended Terms.
